DOT Regulations & Medical Marijuana

If an employee tests positive on a DOT Drug Test per DOT Regulations they must be removed from their safety sensitive position, referred to a Substance Abuse Professional (SAP) and must completed the Return-to-Duty process before being able to return to work.  The employee must also follow the SAP’s Drug &/or Alcohol Follow-Up program after returning to work.

The process would be the same even if a state allows the use of Medical Marijuana.  This is due to this employee being a DOT Employee and the Federal law supersedes the State law.
